Terms of service

1. Who provides the service

Menudetto is provided by Mattia Mellone, sole trader, VAT no. IT07993850721, Via Martin Luther King 19 int. 10, 70124 Bari (BA), Italia. Contact: privacy@menudetto.com.

2. Who it is for

Menudetto is meant for people who run a food or drink venue — restaurant, pizzeria, bar, trattoria, farm restaurant, ice-cream parlour, pub — or work in one, and use it for their business. By creating an account you declare that you use it for this purpose.

3. The service

With Menudetto you create your menu by chat, by voice or from a photo, translate it, publish it on a page your customers open by scanning a QR code, print it and, with the Pro plan, use the tools described on the Pricing page. The service evolves: we may add, change or remove features.

We do our best to keep it always available, but we cannot guarantee it will run without interruptions, for example during maintenance or a provider outage.

4. Your account

Keep your credentials safe: what happens from your account is attributable to you. You can invite staff to your team with a role, and you decide who joins and with which permissions.

5. Plans, prices and cancellation

The Free plan costs nothing, needs no credit card and has the limits described on the Pricing page.

The Pro plan costs €19 a month, VAT included. It is paid in advance by card through Stripe and renews by itself every month until you cancel it.

You can cancel whenever you like from Settings → Manage subscription: Pro stays active until the end of the month already paid, then you go back to Free without losing your menu. We do not refund the current month, except where the law requires it.

If we change the price we tell you at least 30 days in advance: the new price applies from the next renewal, and until then you can cancel.

Complimentary Pro periods — the year for the first 20 founders, which you get by leaving your email in the founders form and then creating the account with the same email, or the month from an invitation — need no card and do not renew when they end: unless you choose to pay for Pro, you go back to Free.

6. Your menu and your responsibilities

The menu is yours: the texts, photos and data you upload remain yours. You allow us to store, process, translate and publish them as far as needed to provide the service, including the menu's public page.

You are responsible for what you publish — names, prices, descriptions — and in particular for the allergen information you must give your customers (EU Reg. 1169/2011).

The assistant proposes: allergens from the ingredients, translations, descriptions, changes. A proposal only goes into the menu when you confirm it. Proposals are an aid and do not replace your professional judgement; check translations before relying on them for important information.

7. Publishing with allergens still to be verified

You can publish the menu even before confirming the allergens the assistant proposed (“Publish now”). In that case the public menu shows those dishes with the allergens marked “to be verified” and a notice inviting customers to ask the staff.

It is your choice and you remain responsible for it: until you confirm them you must be able to give customers the correct allergen information, for example with written documentation available in the venue. We recommend confirming them as soon as possible: the quick sweep takes about 5 minutes.

8. Fair use

You may not use Menudetto for unlawful, misleading or rights-infringing content, nor try to get around its technical or security limits. If that happens we may suspend or close the account, warning you beforehand where possible and always with a statement of reasons, as section 9 explains.

9. Reporting content and point of contact

The menus published with Menudetto are written by the venues, also with the assistant's help, and remain their responsibility: we store them and show them on their behalf, as a hosting service under Regulation (EU) 2022/2065 (Digital Services Act). We don't monitor menus in general and we don't use automated systems to moderate them: we act on a notice or on an order from an authority, and every decision is taken by a person.

If you find content on a public menu that you believe is illegal — for example false allergen information, an offensive text, a trademark or a photo used without the right to do so — write to us at segnalazioni@menudetto.com. At the bottom of every public menu there is the “Report content” link, which prepares the email with the menu's address. In your notice, include:

• the address of the menu (the one the QR code opens) and the dish or text you mean;
• why you believe that content is illegal, explained precisely enough for us to assess it;
• your name and email address;
• a statement that the information in the notice is accurate and complete, in good faith.

We confirm that we have received your notice, we assess it in a timely, diligent and objective manner, and we tell you what we have decided and how you can challenge it.

If we restrict content or an account — we remove or hide a dish or a text, take a menu offline, suspend or close the account — we write to the venue concerned with a clear statement of reasons: what we did, which facts and which rule (the law or these terms) we relied on, and how it can challenge the decision.

If you disagree with one of our decisions, because you sent the notice or because it concerns your menu, write to us at the same address explaining why: we review it and reply with our reasons. You can always go to court as well.

Single point of contact: for those who use the service (venues and people reading menus) and for the authorities of the Member States, the European Commission and the European Board for Digital Services, the point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065 is segnalazioni@menudetto.com. 10. Liability

We are liable for damage caused by wilful misconduct or gross negligence. In other cases, and within the limits allowed by law, we are not liable for indirect damage, such as loss of profit, and our total liability does not exceed what you paid us in the previous 12 months.

11. Personal data and our role as processor

Your own data is covered by the privacy policy.

For other people's data that you enter — the email addresses of the staff you invite, the suppliers in the invoices you upload — you are the controller, and Menudetto processes it on your behalf as a processor (art. 28 GDPR). In particular we undertake to:

• process it only to provide the service and following your instructions, that is the actions you take in the app;
• have it processed only by people bound to confidentiality and protect it with appropriate security measures;
• rely on the providers listed in the privacy policy, which you authorise by accepting these terms, and tell you if we add or change one, so that you can object;
• help you answer requests from the people concerned and notify you without delay of any breach affecting that data;
• delete it when you delete the account, except for the backup copies for the periods stated in the privacy policy;
• give you the information needed to show that these obligations are met.

12. Duration and closure

You can delete the account whenever you like from Settings: published menus and QR codes stop working immediately. If we decide to close the service we tell you at least 30 days in advance and refund the part of Pro you paid for and did not use.

13. Changes to the terms

If we change these terms significantly we tell you by email or in the app at least 30 days in advance. If you do not agree you can cancel Pro or delete the account; if you keep using the service after that date, the new terms apply.

14. Governing law and jurisdiction

These terms are governed by Italian law. The courts of Bari have jurisdiction over any dispute.
